行政约谈法治化探究——基于食品安全监管的视角

Research on the Legalization of Administrative Interview

行政约谈作为一种新兴的行政执法方式,契合了服务型政府理念,迎合了公民参与行政的需求,尤以及时回应社会关切、提高政府部门行政效率见长,逐渐被应用于税收、环保、卫生、工商、质监、食药监(现为市场监管)等行政活动的各个领域。但迄今为止没有一部高位阶的法规对行政约谈的适用主体、适用范围、约谈内容、法定程序、事后监督等作出具体详细的规定,缺少高位阶的法律来指导和规范行政约谈这一新兴行政行为,其结果就是行政约谈被滥用,与现有行政行为体系无法有效衔接,无法达到行政管理体制创新的目的。笔者试以食品安全监管的视角探究行政约谈法治化,以期推动行政执法方式深层次变革和管理体制创新的进一步完善。

As a new administrative law enforcement method,administrative interview conforms to the concept of service-oriented government and meets citizens’needs to participate in administration.It is especially useful for quick response to social concerns and improving the administrative efficiency of government.It has gradually been applied to various administrative activities such as taxation,environmental protection,health,industry and commerce,quality supervision,food and drug supervision(now market supervision).But so far there is no high-level regulation that makes specific and detailed provisions on the applicable subjects,scope of application,content of interviews,legal procedures,and post-supervision of administrative interviews.There is no high-level regulation to guide and regulate this new administrative action.As a result,administrative interview is abused.It is not effectively connected with the existing administrative act system,and the innovation in administrative management system is not achieved.The author tries to probe into the legalization of administrative interviews from the perspective of food safety supervision practice,with a view to promoting the in-depth reform of administrative law enforcement methods and the further improvement of management system innovation.
