扰乱公共秩序罪定罪量刑标准问题研究

Study on the Standard of Punishment for the Crime of Disturbing Public Order

在人类社会不断发展进步的同时,也不可避免地产生了社会公众矛盾。法律是解决这些矛盾的重要手段。现如今,因公众关注的问题得不到及时、有效地解决而引发的扰乱公共秩序问题呈现出逐年上升的趋势,对国家经济发展和社会稳定产生严重的阻滞作用。因此,对扰乱公共秩序罪定罪量刑标准的确立具有重要意义。本研究从扰乱公共秩序罪的定义出发,在分析扰乱公共秩序罪定义、主要特点和形成原因的基础上,结合定罪量刑标准现状,采用理论研究和定性分析相结合的方法,对扰乱公共秩序罪定罪量刑问题进行深入剖析,并分析探讨相应的解决措施,为打造良好的法治环境提供建议和支持。

With the continuous development and progress of human society,social conflicts arise inevitably.Law is an important means to resolve these contradiction.Nowadays,public order disturbances caused by problems of public concern that cannot be solved in a timely and effective manner are on the rise year by year,seriously hindering national economic development and social order stability.Therefore,it is of great significance to establish the sentencing standard for the crime of disturbing public order.Starting from the definition of the crime of disrupting public order,based on the analysis of main characteristics and the causes,referring to criterion for the conviction,and combining theoretical research and qualitative analysis,this paper probes deeply into criterion for the conviction of disrupting public order and studies the corresponding solutions in order to provide advice and support for the environment of the rule of law.
