校外其他教育机构教师惩戒权研究

A Study about the Disciplinary Right of Teachers in after-school Training Institutions

学校外其他教育机构的教师惩戒权是一种民事权利,来自于和学生订立的教育服务合同,具有合同目的性、平等性、教育性、自愿性等特点。其法律基础来自《教育法》第二十九条、第三十条关于“其他教育机构的权利与义务”以及《教师法》第七条、第八条针对“教师的权利与义务”之规定。其他教育机构的教师惩戒作为教育的一种手段和方式,与一般学校教师惩戒存在较大差别。学校惩戒的前提是双方地位不对等,而其他教育机构的惩戒是在教师与学生平等的地位上作出的。就救济方式而言,其他教育机构中被惩戒的学生还可以依据民事诉讼途径获取救济。

Teachers’disciplinary right in after school training institutions is a kind of civil right,which comes from the educational service contract concluded with students.Its legal basis is the right and obligation of after school training institutions stipulated in article 29 and article 30 of“education law”,and the right and obligation of teacher stipulated in article 7 and article 8 of“teacher law”.As a method and way of education,teachers’disciplinary right in after school training institutions quite different from that in schools.Teachers in the after school training institutions discipline students on an equal footing,while after school training punish students on an unequal footing.In terms of remedies,disciplined students in after school training institutions can also receive relief through civil litigation.
