我国民用无人机制度的弊端与完善路径

Research on the Defects of China's Civil Drone Systemand Its Improvement Path

无人机产业的快速发展对当前航空法制建设提出了诸多挑战,总体沿袭通航法规及其监管制度的我国无人机制度未能充分满足无人机产业发展的现实需要。针对上述问题,一方面应当吸收借鉴欧盟无人机专门性法规“Commission Implementing Regulation(EU)945&947”、美国联邦与各州立法中的先进理念;另一方面应参考欧洲U-space与美国UTM等无人机监管平台建设经验,为我国UOM平台的建设重点提供导向,以期完善现行无人机制度,为无人机产业的快速发展提供坚实的制度支撑。

The rapid development of the drone industry has put forward many challenges to the current aviation legal system construction.China's drone system,which follows the general navigation regulations and its regulatory system,fails to fully meet the practical needs of the development of the drone industry.In view of the above problems,on the one hand,China should learn from the advanced ideas in Commission Implementing Regulation(EU)945&947 and also state and federal laws of the United States;on the other hand,China should also draw experience from the construction of drone monitoring platforms of EU U-space and US UTM,and use them as the guidance for our UOM platform construction so as to improve the current drone system and offer the solid system support for the rapid development of the drone industry.
