摘要
制度供给的不足与排他,阻碍教师通过教师申诉保障自身权益。教师申诉的功能定位和教师法律身份多元化趋势,使得教师申诉完善面临双重困境。行政复议、行政诉讼、劳动人事争议处理制度、事业单位工作人员申诉和公务员申诉等其他救济途径已为教师权益保障提供充足制度资源。在现有救济途径充足的背景下,无须进行重复建设,应当废止教师申诉制度,使得其他救济途径的制度资源得到充分利用,以确实保障教师权益。
The lack and exclusion of system supply prevent teachers from protecting their own rights through teachers’appeal.The functional orientation of teachers’appeal and the trend of diversified teachers’legal status make the perfection of teachers’appeal face a double dilemma.Other remedies,such as administrative reconsideration,administrative litigation,the resolution system of labor and personnel dispute,the appeal of public institution staff,and the appeal of civil servant,have provided sufficient institutional resources for the protection of teachers’rights and interests.In the context of sufficient existing remedies,there is no need to repeat the construction.Hence,the appeal system of teachers should be abolished so that the institutional resources of other remedies can be fully utilized to ensure the protection of teachers’rights and interests.
