近年来猥亵儿童犯罪在全国范围内呈高发态势,猥亵儿童犯罪表现出区域数量分布不均、网络猥亵儿童案件数量增多、熟人作案率高、隐蔽性强等特点。目前我国对于猥亵儿童犯罪治理存在立法规定过于笼统,对儿童的年龄缺乏明确界定,对犯罪的惩治力度不足,缺乏法律以外的后续保护等问题。猥亵儿童犯罪并非我国独有的现象,全球各国、各地区都在为防范猥亵儿童积极努力,当前可以从立法、司法、网络监督、儿童性教育等多个角度完善我国猥亵儿童犯罪问题的治理路径。

In recent years, the child molestation crime happens all over the country with a trend of high frequency.The characteristics of child molestation crime can be presented as follows: The number of regional distribution is uneven, the number of cases of child molestation on the Internet is increasing, the rate of committing crimes by acquaintances is high, and its concealment is strong. Currently, there exists some problems with the governance of child molestation crime in our country, for example, the legislation and regulations are too general, lack of clear definition of children’s age, insufficient punishment power towards the crime, lack of follow-up protection out of the law, etc. Child molestation is not a unique phenomenon in our country. All of the countries and regions all over the world are making active efforts to prevent child molestation, which can provide reference and inspiration for perfecting the legal mechanism of preventing children molestation from the aspects of legislation, judicature, network supervision and sex education for the children, etc.
