新版FIDIC银皮书合同条件下的工程总承包风险研究

Research on EPC Project’s Risk under the Conditions of FIDIC Silver Book of 2017 Edition

从国际总承包项目合同风险角度出发,以FIDIC银皮书(2017版)为研究对象,从不可抗力、合同责任、充分性承诺、工期延误、缺陷责任期、可索赔事项等方面分析合同双方的风险分担机制和应对措施。从风险识别、风险防范、风险处理3个方面将FIDIC与AIA.NEC等合同范本进行比较,总结各自的合同风险特征,为国际工程总承包项目的合同风险管控提供参考。

From the perspective of contract risk of international EPC projects,this paper takes the FIDIC silver book(2017 edition)as the research object,analyzes the risk sharing mechanism and countermeasures of both parties in terms of exceptional events,contract liability,sufficiency commitment,time delay,defect liability period and claimable matters.By comparing FIDIC with AIA,NEC contract conditions from three aspects of risk identification,risk prevention and risk management,this paper summarizes the risk characteristics of the three contracts,in order to provide references for the control of contract risk of EPC projects.
