清末沛县新团案考论——兼及对处理群体性事件的思考

On the New League Case of Peixian County in the Late Qing Dynasty-Thinking about Handling Mass Events

清末,山东灾民与铜山、沛县居民因开垦湖滨荒地发生矛盾,新团与相邻的刘庄寨争斗,酿成群体性流血事件,沛民“京控”,新团被官府平毁。新团事件是典型的群体性事件,在此事件中,官府、沛民、湖团三方对湖团垦荒所持的正当性认识矛盾,博弈激烈。官府的正当性认识虽然借助政府权威主导着事件的处理,但无法统一三方所持的正当性认识,矛盾无法缓解,揭示出法律、政策等赋予的正当性认识在政府权威支持下对解决群体事件所发挥的作用。

In the late Qing Dynasty,because of the contradiction between the victims of Shandong Province and the residents of Tongshan and Peixian County,the new regiment fought with the neighboring Liuzhuang village,resulting in mass bloodshed.Pei people were “controlled by Beijing”,and the new regiment was destroyed by the government.The xintuan incident is a typical group event.In this event,the government,Pei people and Hutuan had contradictory understanding of the legitimacy of the reclamation,and the game was fierce.Although the government's understanding of legitimacy dominates the handling of the incident with the help of the government authority,it cannot unify the three-party understanding of legitimacy,and the contradiction cannot be alleviated,thus revealing the role of legitimacy given by laws and policies in solving the group incidents under the support of the government authority.
