公民参与行政立法研究——以正当性、制约因素及实施路径为视角

Reseach on Citizen Participation in Administative Legislation: from the Perspective of Legitimacy, Obstacle and Implementation Approach

公民参与行政立法是公民参与国家政治、经济、文化与社会事务管理的一种具体途径和形式,也是每一位公民基本的权利和义务,它对于深入贯彻习近平总书记所倡导的"以人民为中心"的理念、监督行政机关依法行政、提高行政效率和降低行政立法成本,具有十分重要的意义。然而,受现行法律制度的限制、行政机关价值偏好的影响、公民参政素质的欠缺以及民众集体行动的困难,公民参与行政立法面临诸多的障碍。为此,需要完善相关的法律法规,强化行政立法者的公民权利意识,创新行政组织文化,增强公民法制观念和参政能力,建立保障公民参与行政立法的体制机制,扎实推进公民参与行政立法的进程。

Citizen participating in administrative legislation is a specific way and form of people to participate in the management of national,economic,cultural and social affairs,it’s also each citizen’s basic rights and obligations.It has important significance to carry out general secretary xi advocated by the concept of"people centered",administrative supervision and administrative organs in accordance with the law,improve the administrative efficiency and reduce the cost of administrative legislation,However,due to the restriction of current law system,the preferences of administrative organ tool selection,the lack of citizen political quality as well as the dilemma of collective action,citizen participation in administrative legislation faces many obstacles.To this end,administrative legislators need to strengthen citizen’s rights awareness,perfect the relevant laws and regulations,Innovate the culture of administrative organization,enhance citizen’s awareness of democratic legal system and the ability to participate,establish the system mechanism to safeguard citizen participation in administrative legislation,and promote the process of citizens’participation in administrative legislation.
