摘要
随着2017年《深化粤港澳合作推进大湾区建设框架协议》和2019年《粤港澳大湾区发展规划纲要》出台,粤港澳大湾区一体化协同发展的蓝图已经完全展开,一体化发展趋势更加突出。《纲要》提出要坚持大湾区的绿色可持续发展,保护大湾区生态环境。因此,在“一国两制”的法制背景下,建立粤港澳环境司法协同机制,共同保护、治理粤港澳大湾区的生态环境势在必行。粤港澳大湾区可以选择“双层协作”的环境法治协同模式,也就是从构建高层政府联席会议的顶层设计和优化区际环境司法协作,设立大湾区环境法庭,协调粤港澳环境法律的制度与标准,共同建立粤港澳大湾区环境司法协同机制,统筹治理粤港澳大湾区的生态环境。
Ever since the birth of the Framework Agreement of deepening Guangdong,Hong Kong and Macao Cooperation to promote the Construction of the Greater Bay area in 2017,and the Outline of the Guangdong-Hong Kong-Macao Greater Bay Area Development Plan in 2019,Guangdong-Hong Kong-Macao Greater Bay Area's integrated and coordinated development has been fully spread out.The outline proposes to adhere to the green and sustainable development of the Greater Bay area,protect the ecological environment of the Bay area,and establish joint protection of environmental justice in the Bay area under the legal background of One country,Two systems.It is a real demand to control Guangdong-Hong Kong-Macao Greater Bay Area's ecological environment.The Guangdong-Hong Kong-Macao Greater Bay Area can choose“double-layer cooperation”judicial coordination,which means to make joint efforts to construct the Greater Bay's environmental and judicial coordination mechanism,and the ecological environment of the Greater Bay Area of Guangdong-Hong Kong-Macao.
