我国刑法修订模式的总结分析与反思展望——基于对十个刑法修正案的数据统计

Summary,analysis,reflection and prospect of revision mode of Criminal Law in China——Based on the statistics of ten Criminal law Amendments

自我国1997年刑法颁行以来,先后出台的十个刑法修正案对其进行了大量的修订。通过对修正案进行的数据统计,可以总结出我国刑法修正案的技术特点主要包括修订频率高、涉及条文数量多、新增罪名数量多,修订类型中增加多、删除少,总则改动少、分则改动多且各章分布极不平均。进一步分析,刑法修订过程中存在的主要问题包括修订过于频繁,极大地影响了刑法的稳定性;修订缺少总体规划,呈现出因事立法的特征;总则与分则之间的修订不够协调,过分聚焦分则罪名的修订,很大程度上忽视了总则规定的存在与完善。通过分析、反思与展望,问题的症结在于我国选择的刑法修订模式;解决问题的基本出路在于未来中国的刑法修订应摈弃单一的刑法典模式,采用分散式、多种法律渊源并行的模式。

Since the promulgation of "Criminal Law "in China in 1997,ten amendments to the Criminal Law have been issued to amend it. Through the statistics of the amendments,it can be concluded that the technical characteristics of China’s amendments to the Criminal Law mainly include high frequency of amendments,a large number of articles involved,a large number of new crimes,more amendments but few er deletions,few er changes in the general rules but more changes in the sub-rules and uneven distribution of the chapters. Further analysis,the main problems in the revision process of Criminal Law include that the revisions are too frequent,w hich greatly affects the stability of the criminal law;the revisions lack an overall plan,show ing the characteristics of the legislation for matters;the revisions betw een the general rules and the sub-rules are not coordinated enough,and excessive focusing on the revision of the crimes of the sub-rules largely ignores the existence and improvement of the general rules. Through analysis,reflection and prospect,the crux of the problem lies in the revision mode of Criminal Law chosen in China;the basic solution to the problem lies in the fact that the future revision of Criminal Law in China should abandon the mode of single criminal code and adopt a decentralized mode w ith multiple legal sources parallel.
