全面依法治国背景下反垄断法经营者定义的立法完善

Legislative Perfection of the Definition of the Operator in the Anti-monopoly Law in the Context of the Overall Rule of Law

“经营者”是《反垄断法》调整的基本主体,也是该法规范的三种垄断行为的主体。受制于当时立法技术,《反垄断法》中经营者的概念无法涵盖现阶段市场经济中能够实施垄断行为的所有主体,导致实践中对经营者的认定有时会偏离《反垄断法》的具体规定。对“经营者”定义的立法完善,应该规范经营者的主体类型和行为对象,设置兜底条款,增加立法解释和司法解释,使之更好地调节市场经济运行。

The“operator”is the basic subject of(Anti-monopoly Law)adjustment,and the subject of the three types of monopolistic behavior in the law.Restricted by the legislative technology at that time,the concept of the operator in the“Anti-Monopoly Law”cannot cover all the subjects that can implement monopolistic activities in the market economy at this stage,resulting in the identification of the operator in practice sometimes deviating from the specific provisions of the Anti-Monopoly Law.The legislative improvement of the definition of“operator”should standardize the main types and behavior objects of the operators,set up comprehensive clauses,increase legislative interpretations and judicial interpretations,so as to better regulate the operation of the market economy.
