《黄河法》中的规划制度研究

Research on Planning System in Yellow River Law

黄河流域生态保护和高质量发展需要制定《黄河法》,规划是《黄河法》中应当确立的重要制度之一。黄河规划是基于黄河水域系统的规划;《水污染防治法》等法律中的相关规划属于水资源规划中的专业规划,现行黄河流域规划是黄河规划的基础性内容;黄河规划属于生态空间规划,《土地管理法》确立了水资源规划在国土空间规划中的基础性地位。因此,《黄河法》应当确定黄河规划的编制主体是水利部,对象是以黄河水域系统为基础的生态空间,内容包括流域综合规划、专业规划、绿色生态空间规划和其他生态空间规划;明确黄河规划应当和国务院审批的国土空间规划保持一致,遵循战略性、科学性、协调性、可操作性的原则;确立黄河规划的权威,健全沿黄土地用途管制制度,完善监督规划实施的制度。

Ecological protection and high quality development in the Yellow River Basin needs formulating Yellow River Law,planning is one of the important systems that should be established in Yellow River Law.In view of the research status of Yellow River Law,the yellow river planning is based on the Yellow River water system,it is demonstrated from the following five aspects,including fluidity of the Yellow River,transboundary factors of the Yellow River,diversity of Ecological Protection Objects in the Yellow River Basin,achieve synergy among different regions and departments,realize high-quality development of the Yellow River Basin.The Yellow River Planning is ecological spatial planning who based on water resources planning,it is demonstrated from the provisions of existing laws and relevant documents.The planning system in The Yellow River Law mainly includes following four aspects,the subject and approval procedure of planning,content of planning,principles of planning and implementation and supervision of planning.
