中国水稻植物新品种权保护现状与分析

Current Situation and Analysis on Protection of New Plant Variety Rights of Rice in China

20 a来,中国植物新品种保护取得了长足的进展。统计和分析了中国水稻植物新品种权申请和授权情况,对中国水稻植物新品种保护过程中存在的问题进行了讨论,并就加强水稻植物新品种保护提出了建议,以推动中国水稻品种的培育和品种权保护的发展。20 a来水稻植物新品种权共受理申请7 286件,授权3 568件,申请量和授权量逐年增加。针对中国水稻植物新品种保护过程中存在的问题,呼吁水稻育种家提高知识产权保护意识,提出了建立实质性派生品种制度、延长保护期限等建议。

In the past 20 years, the protection of new plant varieties(PVP) has made remarkable achievements in China. The statistics and analysis were conducted on the number of applications and grants of plant variety rights in rice of China. The existing problems in the process of protection of new rice varieties in China were discussed, and the suggestions were proposed for strengthening the protection of new rice varieties to promote the breeding and PVP of rice. Up to now, there have been 7 286 filed and 3 568 granted rice variety rights in China with an increased trend year by year. Aiming at the existing problems in PVP of rice, the authors appealed to rice breeders for enhancing awareness of protection of variety rights and proposed to establish an EDV system and extend the term of protection of variety rights.
