法治扶贫的现实困境及机制建构——基于贵州省的考察

On the Practical Dilemma and Mechanism Construction of Poverty Alleviation Under the Rule of Law——Based on the Investigation of Guizhou Province

近年来法治扶贫工作取得的成效相当显著,但还面临一些困境,包括农村法治教育水平低,扶贫法律供给不足,农民维权机制需要完善;扶贫主体的法治意识有待于提高,农民权利保障机制虚置;社会力量参与扶贫的激励机制效率低下;扶贫资金、项目管理机制不完善,缺乏长期有效的监督机制等。需要从全面增强法治意识,加强法治教育及健全扶贫法律体系;提高扶贫主体的法治意识,构建贫困群体的民生权利体系;建立多元化主体参与的法律激励体系;完善扶贫资金、项目管理机制,建立长期有效的监督机制等方面完善,确保贫困地区顺利脱贫。

In recent years,the work of poverty alleviation under the rule of law has achieved remarkable results,but it still faces some difficulties,including the low level of education under the rule of law in rural areas,the insufficient of legal supply for poverty alleviation,and the need to improve the mechanism of safeguarding farmers’rights;the lack of legal awareness of poverty alleviation,the ineffective mechanism of ensuring farmers’rights,the inefficient of incentive mechanism of social forces participating in poverty alleviation,the imperfect of the funds and project management for poverty alleviation,and lack of long-term effective supervision mechanism and so on.So we need to improve the awareness of the rule of law in an all-round way,strengthen the education of the rule of law and improve the legal system of poverty alleviation;improve the awareness of the rule of law of the main body of poverty alleviation,build the system of people’s livelihood rights of the poor groups;establish a legal incentive system with the diversified participators;improve the management mechanism of poverty alleviation funds and projects,and establish a long-term and effective supervision mechanism,so as to ensure that the poor areas can get rid of poverty smoothly.
