Research on Subjects and Legal Status of Audio-visual Works

摘要 网络视听产业是互联网影视娱乐业经济增长最快的领域。多国法律有"电影作品"规定,但是,随着互联网科技高速发展,"电影作品"的法律制度面临挑战,国际上逐步使用"视听作品"的概念,以涵盖网络视频、网络直播等新型作品。《中华人民共和国著作权法修改案(草案)》新增"视听作品"概念,但"视听作品主体制度"没有作相应修改,未能正确定位参与主体的法律地位,也没有充分考虑视听作品参与主体的新变化,严重影响了网络视听产业的发展,建立新型的视听作品权利主体法律制度成为当务之急。 Network audio-visual industry is the fastest growing area of Internet Film and television entertainment industry.At present,The film works has been regulated by law in many countries.However,with the rapid development of Internet technology,the legal system of"film works"is facing challenges.The concept of"audio-visual works"is gradually used in the world to cover new types of works such as online video and live internet broadcast.The concept of"audio-visual works"has been added to the revised draft of China’s copyright law.However,the"subject system of audio-visual works"has not been revised accordingly.It has not correctly positioned the legal status of the participants and has not fully considered the new changes of the participants of audio-visual works,which has seriously affected the development of the network audio-visual industry.Therefore,it is urgent to establish a new legal system of the subject of rights of audio-visual works.
