刑事案外人涉财执行异议的种类及其救济路径

The Types of Criminal Outsider’s Executive Objection to Criminal Judgments Involving Property and Relief Paths

根据司法解释规定,刑事案外人在执行阶段可提出三种执行异议:认为执行行为违法的程序异议、针对执行标的主张实体权利的实体异议、认为刑事裁判认定赃款赃物错误的实体异议。不同于民事执行异议的三种救济路径,司法解释对刑事案外人的执行异议只规定了两种救济路径:复议程序与审判监督程序。复议程序适用前两种刑事案外人执行异议,审判监督程序适用第三种刑事案外人执行异议。通过复议程序解决刑事案外人针对执行标的主张实体权利的异议与通过审判监督程序解决刑事案外人认为刑事裁判认定赃款赃物错误的异议,均存在不足之处。

According to judicial interpretation,an outsider of a criminal case is entitled to raising three kinds of executive objection in the stage of execution:procedural objection to the illegal execution,substantive objection to the subject matter of enforcement claiming substantive rights and substantive objection to the criminal judge’s mistake in identifying stolen money and goods.Different from three relief paths for civil executive objection,judicial interpretation only provides two relief paths for criminal outsider’s executive objection:relief paths of reconsideration procedure or trial supervision procedure.Reconsideration procedure is applied to the first two kinds of outsider’s executive objection in criminal cases,and trial supervision procedure is applied in the third kind of executive objection by an outsider.There are deficiencies both in solving the criminal outsider’s objection to the subject matter of enforcement claiming substantive rights through the reconsideration procedure and solving the criminal outsider’s objection to the criminal judge’s mistake in identifying stolen money and goods through the procedure of trial supervision.
