突发群体性治安案件的行动逻辑与法律治理——由华北J县一起警务案例展开

On Action Logic and Legal Governance for Mass Incidents of Public Order:Inspiration from a Policing Case in J County of North China

目前我国处于社会转型时期,社会结构的裂变不可避免地引发一定的社会纠纷,而突发群体性治安案件正是其表现之一。社会结构混乱造成的规范真空与控制失灵,以及群众法律意识的内卷化是当前存在的困境。为此,需要采取的法律治理措施为:建立健全利益诉求表达机制、社会纠纷解决机制、法律援助工作机制、政府信息公开机制和社会风险疏导机制;完善国家治安管理和应急管理所需的法律规范体系,确保在有法可依的前提下实现良法善治;通过长期的法治教育系统工程,传递必要的法律知识、正确的法律观念给广大公民,以克服法律意识的内卷化。

At the stage of social transformation,the disintegration of China’s social structure has inevitably triggered certain social disputes,among which the sudden mass incidents of public order are included.Currently,there exist the dilemmas of the institutional vacuum and ineffective control caused by the chaotic social structure,and the involution of citizens’legal consciousness.Thus,the following legal governance measures should be taken:to establish and perfect the mechanisms related to interest expression,social dispute resolution,legal aid,government’s information disclosure and social risk mitigation;to improve the legal system required by national public order management and emergency response for ensuring the realization of"good law and good governance"on the premise of laws;to impart legal knowledge and correct legal concepts to the citizens through the long-term legal education system project for overcoming their involution of legal consciousness.
