摘要
“竞争中立”最初是澳大利亚和欧盟为规制域内市场环境而设立的约束国有企业不当竞争的制度。发达经济体关于竞争中立制度的推广,表面上是新的国际经济规则制定权之争,但背后反映的是全球贸易主导力量之争。必须辩证审视这一原则在国内法层面和国际法层面的本质属性和发展路径,理性提出符合我国长期利益的制度选择和实践。
"Competitive neutrality"was an institution originally introduced by Australia and the European Union to restrict the improper competition of state-owned enterprises and thus regulate their market environment.The marketing of competitive neutrality by the developed economies is superficially a dispute over the right to make new international economic rules,but actually it is a dispute over the dominant power of global trade.It is necessary to examine dialectically the nature and development path of this principle at the levels of domestic law and international law,and rationally put forward China’s proposition and practice in line with China's long-term interests.
