企业排污权交易制度存在的问题探讨

生态环境部印发《关于做好固定污染源排污许可清理整顿和2020年排污许可发证登记工作的通知》,确立了排污许可全覆盖的目标,并要求于2020年全力完成。在这种背景下,排污权交易存在着巨大的市场需求,然而我国现存的排污权交易实际障碍很多,对其进行深入研究是十分有必要的。基于此,本文提出如下完善措施:(1)运用区块链搭建二级交易平台;(2)政府设置排污权保护价;(3)运用"区块链+物联网""模式进行监管;(4)政府制定监管规范,规范监管主体、范围、方式等;(5)排污权在法律上的属性及地位,完善相关法律制度,并加强与现有制度对接。

The Ministry of Ecology and Environment of the People’s Republic of China issued the "Notice on Doing a Good Job in Cleaning and Rectifying Stationary Pollution Discharge Permits and 2020 Emission Permit Issuance and Registration Work". It has established the goal of full coverage of discharge permits and requires full efforts by 2020.There is a huge market demand for emissions trading, however, there are many practical obstacles to the existing emissions trading in my country. the article proposes:(1)Use blockchain to build a secondary trading platform;(2)The government sets the protection price of emission rights;(3)se the "blockchain + Internet of Things" model for supervision;(4)Issue detailed government supervision documents, and set up a special regulatory agency to regulate the main body,scope,and methods of supervision.(5)Determine the legal attributes and status of the emission rights, improve the relevant legal system, and strengthen the connection with the existing system.
