《民法典》对侵权责任规则的修改与完善

The Amendment and Improvement of Tort Liability Rules in the Civil Code

《民法典》第七编"侵权责任"对侵权责任规则的修改是比较全面的,突出了侵权责任作为债法内容的损害赔偿之债的属性,确定了侵权责任规则与第一编"总则"之间的关系。在此基础上,对侵权责任的一般性规则和特殊侵权责任规则都作了较大的修改,既有对新的特殊侵权责任类型的增加,又有对具体侵权责任规则的补充和修改,使我国侵权责任规则得到了进一步完善,既具深厚理论性基础,又有现实可操作性,将会在调整侵权法律关系、制裁侵权行为、预防侵权行为发生和保护民事权益方面,更好地发挥法律调整作用。

The modification of the tort liability rules in"Tort Liability",Part 7 of the Civil Code,is comprehensive,highlighting the nature of tort liability as a liability for damages in the content of the debt law,and determining the relationship between the tort liability rules and the general provisions relationship.On this basis,it significantly revises both the general rules and the special rules of tort liability.It not only adds new types to the special tort liability,but also supplies and modifies many specific tort liability rules,making a further improvement for our tort law.It has a deep theoretical foundation and a solid operability,and will play a better role in adjusting infringement legal relations,sanctioning infringements,preventing infringements,and protecting civil rights.
