“三权分置”背景下宅基地退出风险分析与防范——以吉林省长春市九台区为例

Analysis and Prevention of Risk in Homestead Withdrawal under the Background of"Three Rights Separation",Taking Jiutai District of Changchun City of Jilin Province as an Example

宅基地"三权分置"是推动现代农村宅基地制度变革的制度性轮子,作为一项重大的创新性制度,对于统筹城乡发展,推进城乡一体化进程具有积极的作用,但也应该对宅基地退出中的风险加以重视。文章以吉林省长春市九台区宅基地退出试点为例,阐述了九台区宅基地退出现状,分析了现阶段在宅基地退出中农户安置、农户收益、农户社会保障和法律等方面的风险,提出了建立宅基地退出社会保障机制、建立收益风险监管机制和建立宅基地退出专项法律制度等加强宅基地退出风险防范的建议。

The"Three Rights Separation"of homestead is an institutional wheel to promote the reform of modern rural homestead system.As a major innovative system,it plays a positive role to balance urban and rural development,promoting the integration of urbanization.But risk prevention in homestead withdrawal should also be paid attention to.Taking Jiutai District of Changchun City of Jilin Province homestead withdrawal pilot as an example,the current situation of homestead withdrawal in Jiutai District was expounded,and risks of the current homestead withdrawal in the resettlement of farmers,farmers'income,farmers'social security and law were analyzed in the paper.Suggestions to reduce the risk in homestead withdrawal process were put forward,such as constructing homestead withdrawal social security mechanism,setting up the income risk supervision mechanism,and establishing special legal system,etc.
