利益衡量视角下互联网竞争行为的正当性认定研究 被引量:6

摘要 由于立法不可避免地具有滞后性,2017年修订的《反不正当竞争法》仍未能穷尽列举互联网领域竞争行为,需要援引该法第2条的商业道德标准对竞争行为正当性进行判定。但商业道德标准具有一定局限性,互联网竞争行为正当性认定中有必要引入利益衡量方法。对于利益衡量方法的展开,首先要界定经营者利益、消费者利益和社会公共利益的内涵,对其中存在的利益冲突,需要进行利益平衡。具言之,有限保护经营者利益,重视考量消费者利益,以社会公共利益为最终标准,从而判定互联网竞争行为的正当性。 Since the legislation is inevitably lagging behind,the Anti-Unfair Competition Law amended in 2017 still fails to list all the competitive behaviors in the Internet field,and it is necessary to judge the legitimacy of competitive behavior in accordance with the business ethics standards of Article 2 of the Law.Due to the limitations of business ethics standards,it is necessary to introduce interest measurement method into the legitimacy identification of Internet competitive behaviors.For the development of the interest measurement method,the connotation of operator's interest,consumer's interest and public interest should be defined first,and the interest conflict should be balanced.To be specific,it is limited to protect the interests of operators,paying attention to the interests of consumers,taking the public interest as the final standard,and thus judging the legitimacy of Internet competition.
