法律职业资格考试背景下本科刑法学教学改革的设想——以河南检察职业学院为例

On the Teaching Reform of Undergraduate Criminal Law under the Background of Legal Qualification Examination——Taking Henan Procuratorial Vocational College as an Example

2018年国家司法考试正式改为国家统一法律职业资格考试(简称"法考",以下统称"法考")。"法考"既是学生上岗的通行证,也是衡量法学教育成效的试金石。改革后"法考"刑法试题与本科教学内容既有一致性又有一定的差异。在"法考"的背景下应明确刑法学的教学目标,提高教师的司法实践能力,增强案例教学的实际效果,提高学生"法考"的过关率。

In 2018,the national judicial examination was officially changed into the national unified legal vocational qualification examination(hereinafter referred to as"the legal examination"),which is not only the pass for students to work,but also the touchstone to measure the effect of legal education.After the reform,there are both consistency and difference between the criminal examination questions and the undergraduate teaching contents.Under the background of legal examination,we should make clear the teaching goal of criminal law,improve the judicial practice ability of teachers,enhance the actual effect of case teaching,and improve the pass rate of students’legal examination.
