FOB是中国出口最常用的贸易条件。这种条件下,通常买方委托货代租船或订舱,控制货物运输,卖方承担交货义务。尽管卖方与买方货代可能发生业务联系,但两者之间可能存在也可能不存在货代合同关系。是否存在货代合同关系直接涉及卖方的权利义务。卖方须对此采取因应策略。

FOB is the most commonly used terms of trade for China’s exports.Under the condition,usually the buyer entrusts the forwarder to charter or book space,and controls of cargo transport,but the seller is obliged to delivery.There may be business links between the seller and the buyer’s forwarder,but there may be or may not be a contract relationship between them.Whether there is a contract is directly related to the rights and the obligations of the seller.Sellers should adopt different strategies to deal with.
