“结构洞”视角下黑恶势力冲突行为的治理

Research on the Governance of the Conflict Behavior of Evil Forces from the Perspective of"Structural Hole"Theory

面对当前扫黑除恶专项斗争的严峻形势,如何提升对黑恶势力犯罪行为的治理能力一直是学界研究的热点课题。以“结构洞”理论为视角,对黑恶势力冲突行为的起因、发起过程、机制及条件等进行深入研究发现,黑恶势力在冲突中的发起行为存在着向上行关系借“威”(自主性)和向下行关系借“势”(规模化)的明显特征,主要通过占据“结构洞”的有利位置以实现成功发起,整个发起过程受到面子、人情等因素的影响。为此,提出了拳打发起者、剑指响应者、整市场之乱和织法律之网等扫黑除恶专项治理的可行性路径。

Facing the current severe situation of a special crackdown against organized crimes,how to improve the ability of governance of the criminal acts of evil forces has been a hot topic in academia.Based on the investigation of the conflict behavior of evil forces in T County,and from the perspective of the"structural hole"theory,this paper focuses on the cause,initiating process,mechanism and condition of the conflict behavior of evil forces.It is concluded that the initiating acts have the obvious characteristics of borrowing"power"(autonomy)from the upward relationship and borrowing"potential"(scale)from the downward relationship,which is mainly achieved by occupying the favorable position of"structural hole",and the whole initiating process is affected by face,human feelings and other factors.Therefore,this paper puts forward the feasible measures of special governance:to crackdown initiators and responders,to regulate the market in order and to enlarge the coverage of law.All this is of great practical significance.
