摘要 [目的/意义]以专利文献提供的数据为基础,探讨影响专利维持时间的因素,为专利质量评价提供新的指标和研究视角。[方法/过程]以2004年国内申请人向中国国家知识产权局(CNIPA)申请并获得授权的30658件发明专利为研究对象,通过Logistic回归模型,定量分析包括首项权利要求字数的多个指标对专利维持时间的影响。[结果/结论]除首项权利要求字数外的其他指标对专利维持时间的影响与现有研究基本一致。在其他因素不变的情况下,首项权利要求字数与专利维持时间呈负相关关系。首项权利要求字数与专利维持时间之间的关系受专利文献篇幅的调节,专利文献篇幅越长,首项权利要求字数减少对专利维持时间的影响越显著。 [Purpose/Significance]Based on the data provided by patent documents,this paper explores the factors influencing the maintenance time of patent and provides a new indicator and research perspective for patent quality.[Method/Process]Taking the 30658 invention patents that domestic applicants applied in 2004 and were granted by National Intellectual Property Administration,PRC(CNIPA)as a research subject,the influence of multiple indicators including the number of words in the first claim on the patent maintenance time was quantitatively analyzed,by the Logistic regression model.[Result/Conclusion]The impact of other indicators,except the number of words in the first claim,on the maintenance time of patent is basically the same as the current researches.When other factors remain constant,the number of words in the first claim is negatively related to the maintenance time.And the relationship between the two varieties is regulated by the length of the patent document.The longer a patent document is,the more significant the effect of reducing the number of words in the first claim on the maintenance time is.
