论《计量法》的科技法属性与国家计量机构的立法定位

Research on the Science and Technology Law Attributes of Metrology Law and the Legislative Positioning of National Metrology Institute

以国际示范法和部分国家计量立法为研究对象,分析了计量法的监管法与科技法的双重属性。在梳理分析国外立法框架基础上,立足我国《计量法》的科技法属性及其承载的科技建制价值,建议《计量法》修订工作应建立以国家计量机构为中心的国家计量科技基础设施制度,以充分彰显其科技法属性。

Taking the international model law and the metrology legislation of some countries as the research objects,this paper analyzes the dual attributes of the regulatory law and the science and technology law of the metrology law.On the basis of combing and analyzing foreign legislative frameworks and based on the attribute of the science and technology law of the Metrology Law in our country and the scientific and technological institutional value carried by it,this paper suggests that the revision of the Metrology Law should establish a national metrological science and technology infrastructure system centered on national metrology institute,so as to strengthen its attributes of science and technology law.
