摘要
修订的《反不正当竞争法》从商标先用权制度中引入了一个概念——"一定影响"。该概念有其特殊的制度基础——商标法。语境学上,反不正当竞争法和商标法是两种不同的语言环境,包括作为体系性制度的命题系统语境和"一定影响"所处上下文形成的命题语境。语境不同,概念发挥作用的基础、方式等也会发生变化。在新的语境下,在商业标识混淆认定中作为认定标准的"一定影响"的适用,既需要在内涵上进行语义澄清,也需要验证语义时适用特殊的方法。
The newly revised Anti-Unfair Competition Law introduces a concept from the system of rights of prior use of trademark, which is the‘ certain influence’. This concept has its special institutional basis, the Trademark Law. From a contextual perspective, the Anti-Unfair Competition Law and Trademark Law are two distinct contexts, including the propositional systematic context of the systemic system and the propositional context formed by the context in which‘ certain influence’ is located. Depending on the contexts, the basis and methods of applying the concept will change. In the new context, the role of‘ certain influence’ playing in the identification of commercial marks confusion requires both semantic restoration on the content and special methods for verifying the semantics.
