The trend of international strong protection of pharmaceutical intellectual property and its countermeasures

通过对TRIPs协定、TRIPs plus中关于药品知识产权保护相关国际协定及条款进行分析,发现药品知识产权保护在不同阶段的保护内容不同且保护力度呈现增大趋势,体现在药品专利保护期的延长和药品数据保护期限的设置上。

Basis on the analysis of international agreements concerning the protection of pharmaceutical intellectual property in TRIPs and TRIPs plus,it is found that the protected contents differ in different stages and the protection effort increases,which is reflected in the setting of the extension of pharmaceutical patent protection period and the term of protection on the drug data.
