摘要
自上世纪50年代以来,我国监狱学者就改造规律问题进行长达六十年的探索,提出了数十条改造规律。探索改造规律的历程按时间可以分为三个阶段,关于规律的表述由简到繁,成果载体从监狱学类著作逐渐过渡到罪犯教育学类著作。通过比较分析发现,学者所揭示的改造规律多有相似和重复,知识受众对此提出了建设性意见。反思六十年改造规律的探索历程,从历史和逻辑、“规律就是关系”、教育基本规律、规律和原则以及经验关系、“第三世界”与“第一世界”的符合度、认识态度等角度审视改造规律,有助于深化对此问题的认识。
Since the 1950s,Chinese penological scholars have conducted six decades exploration on the law of prisoner reformation,and put forward dozens of reform laws.The course of the exploration can be divided into three stages according to time sequence.And the achievements gradually transitioned from penology to criminal education.Through comparative analysis,it is found that the reformation law revealed by scholars are mostly similar and repeated.Therefore,the knowledge audiences have put forward some constructive suggestions.Reflecting on the 60-year exploration course,examining the reform law from the perspective of history and logic,law and principle of education,as well as empirical relationship,cognitive attitude and so on,it is helpful to deepen the understanding of this issue.
