罪犯有限自治模式是基于监狱治理现代化背景下,对罪犯传统自治模式的重新审视和理性考量。罪犯有限自治应兼具法理、治理和情理三大拓展属性。根据韦伯理想型组织的三种形态,罪犯有限自治组织可设置为规则、文化、价值三种有限自治模式,为防范自治失控状态下还应设置复归模式。

The limited autonomy mode of prisoners is the re-examination and rational consideration of the traditional autonomy mode of prisoners based on the modernization of prison governance.The limited autonomy of prisoners should have the three expanded attributes of jurisprudence,governance and reason.According to the three forms of Weber's theory of ideal organization,the limited autonomous organization can be divided into three models:rules,culture,and value,and there should be a return model to prevent autonomy from running out of control.
