我国智慧法院建设中诉讼平台的规则嵌入——以杭州互联网法院诉讼平台的调解前置规则为例

规则嵌入是指将一个社会的法律规则嵌入各种系统和程序,而该系统或程序的使用者不必知道具体法律规定的细节、无需法律人的提醒就可以遵守法律,其特征在于科技与规范的合一性。我国智慧法院建设中诉讼平台的规则嵌入最典型的体现当属杭州互联网法院的调解前置程序。从调解前置程序在诉讼平台嵌入的背景、特点及成效可以分析我国智慧法院建设中诉讼平台的规则嵌入与智慧社会的相互影响。从调解前置程序嵌入诉讼平台所体现出的“不易为人察觉的强制性”问题可以分析我国法院诉讼平台规则嵌入的完善举措。规则嵌入的深入与广泛应用将开启我国法治的新形态。
