离婚制度中儿童最大利益原则的经济体现——以功利主义与公正理论为视角

Economic embodiment of the principle of the best interests of children in the divorce system--From the perspective of utilitarianism and justice theory

2019年公布的《中华人民共和国民法典(草案)》婚姻家庭编中确立了儿童最大利益原则,尊重和保障儿童权益逐渐成为现代婚姻家庭法的发展趋势。从经济学的角度出发,以边沁的功利主义与罗尔斯的公正理论为例,通过对比分析发现,离婚制度中的儿童最大利益原则更多地体现了公正理论的经济观。

In the civil code of the People's Republic of China(Draft)published in 2019,the principle of the best interests of children has been established in the marriage and family code.Respect and protection of children's rights and interests have gradually become the development trend of modern marriage and family law.From the perspective of economics,taking Bentham's utilitarianism and Rawls's justice theory as an example,it is found through comparative analysis that the principle of the best interests of children in the divorce system more embodies the economic view of justice theory.
