法经济学视角下的隐私悖论研究

On the paradox of privacy from the perspective of law and economics

分析目前大数据时代存在的隐私悖论问题及成因。隐私悖论现象导致当今法律规制的悖论,即旨在保护隐私的法律可能会导致对隐私权的侵害。提出破解隐私悖论困局的建议:通过法律规定强制隐私收集平台提供隐私保护,并告知用户相对应的法律规定。

This thesis analyzes the privacy paradox and its causes in the era of big data.The phenomenon of privacy paradox leads to the paradox of current legal regulation,that is,the law aimed at protecting privacy may lead to the infringement of the right to privacy.It puts forward some suggestions to solve the dilemma of privacy paradox:to force privacy collection platform to provide privacy protection through legal provisions,and to inform users of the corresponding legal provisions.
