On the Issues of the Genuine Pricing of Infringing Products in the Field of Criminal Protection of Intellectual Property Rights

在知识产权刑事保护领域,侵权产品的价值往往是构成犯罪的决定性因素。现有的侵权产品计价标准存在争议,影响对知识产权犯罪的打击效果,也暴露了对知识产权刑事保护不足的问题。侵权产品正品化计价需要对知识产权刑事法律体系作整体性的调整,需要提升侦查能力,需要达成共识。侵权产品正品化计价符合国家知识产权战略要求,有利于策应中美贸易谈判,有利于知识产权刑民保护的衔接,有利于应对侵权犯罪的严峻形势,顺应了国际知识产权保护趋势。应从实际出发,宜从"假冒注册商标罪"切入,扩大推广"补充性标准"适用,发挥指导性案例的作用。

Abstrct: In the field of criminal intellectual property protection, the value of infringing products is usually the decisive factor to decide whether the behavior is a crime. There are several controversial issues in existing pricing standards for infringing products which will affect the effectiveness of the crackdown on intellectual property crimes and that also exposes the lack of criminal protection of intellectual property rights. In order to calculate the genuine pricing of infringing products, it is necessary to make an integral adjustment to the criminal legal system, improve our reconnaissance capability, and reach a consensus on these issues. Reasonable pricing of genuine infringing products accords with the requirements of our national intellectual property strategy. It is helpful to reach agreements in trade negotiations between China and the US and helpful to link up civil protection and criminal protection of intellectual property. Also, it is conducive to dealing with the severe situation of infringement crimes and conforms to the trend of international intellectual property protection. Considering the practice, it is advisable to start improvement from the crime of counterfeiting registered trademark. Then we can popularize the application of the Supplementary Standards and improve utilization of guiding cases.
