人工智能时代的制度安排与法律规制

Institutional Arrangement and Legal Regulation in the Age of Artificial Intelligence

随着经济与科技的飞速发展,人工智能技术得到了发展和普及,但这也为人类社会带来了诸多风险因素。在当前的经济和技术体制下,科技革命对于现行的法律制度带来了巨大的挑战,很多法律体系并没有及时对此作出有力的调整,这就使得在很多方面出现了法律与人权的冲突。论文先阐述了人工智能背景下的风险和人工智能技术对法律的挑战,然后对面向未来时代的制度构成展开讨论,并提出个人的见解。

With the rapid development of economy and science and technology,artificial intelligence technology has been developed and popularized,but it also brings many risk factors for human society.Under the current economic and technological system,the scientific and technological revolution has brought great challenges to the current laws and institution.Many legal systems have not made effective adjustments to these in a timely manner,which has resulted in conflicts between law and human rights in many aspects.This paper firstly describes the risks under the background of artificial intelligence and the challenges of artificial intelligence technology to the law,and then discusses the institutional composition facing the future age,and puts forward personal opinions.
