摘要
推进社会科学普及的法治化建设离不开健全完善的地方立法体系。截止2020年1月,我国共计出台社会科学普及地方立法13部,呈现出时间上集中、主体上单一、数量相对较少、框架结构具有共性等特征。虽然上述立法在一定程度上保障了当地社会科学普及事业的发展,但仍存在:对"社会科学普及"这一基本概念分歧较大;"应当"条款普遍缺乏法律责任条款的配合与支持;部分立法在表述上存在瑕疵,缺乏严谨性;部分立法在社会实践中难以执行,可操作性不强以及缺乏明确针对性,难以体现地方特色等问题。未来,应通过加快社会科学普及国家立法建设,为地方立法提供依托和指引;提升社会科学普及地方立法的数量和质量等路径来优化之。
The promotion of the rule of law in the popularization of social sciences is inseparable from the sound and perfect local legislative system. As of January 2020, China has issued 13 local laws on the popularization of Social Sciences, showing the characteristics of centralized time, single subject, relatively small number and common framework structure. Although the above-mentioned legislation has guaranteed the development of local social science popularization to some extent, it still exists: there is still a large analysis of the basic concept of "Social Science Popularization";the "should" clause generally lacks the cooperation and support of the legal liability clause;some legislations are flawed in expression and lack of preciseness;some legislations are difficult to implement in social practice and have no operability In the future, we should speed up the national legislation construction of social science popularization, provide support and guidance for local legislation, and improve the quantity and quality of local legislation of social science popularization.
