Between Nativity and Cosmopolitanism: How Did Modern Chinese Think About the Legal System of Shanghai Concession

鸦片战争以后,上海产生了租界及其法制。随着这一法制的颁行,近代国人对其研究也逐渐展开,研究成果相继问世。他们笔下的上海租界法制主要有:记载上海租界法制的史料;研究上海租界法制的著作、论文;传播上海租界法制的沪游指南与报纸报道;等等。从近代国人笔下的上海租界法制可得到重要启示,即要正确认识上海租界法制与中外不平等条约、租界建立国法制、华界法制三者的关系。只有正确认识这些关系,才能深刻理解上海租界法制的本质,把对这一法制的研究推向深入。
