摘要
为规范适用《食品安全法》设立的行政拘留制度,本文从食品安全监管行政拘留的概念和特征入手,通过与其他拘留方式比较,分析现行行政拘留程序实施的情况和主要问题。从食品安全行政拘留立法和程序性规范角度提出完善的思路和建议。《食品安全法》法律责任部分设立的行政拘留行政处罚种类,对不构成犯罪的严重食品安全违法行为,可以由公安机关实施短期内限制人身自由的处罚,需细化构建完善的程序规范,使法律制度落实到位,维护良好的食品安全秩序。
To normalize the newly established administrative detention system for the revised Food safety Law,starting with the concept and characteristics of the administrative detention system for food safety regulation,this paper analyzes the implementation situation and flaws of the existing administrative detention procedure by comparing with other forms of detention,and it puts forward some ideas and suggestions regarding the legislation and procedural normalization of administrative detention in food safety regulation.If serious violations of the Food Safety Law do not constitute a crime according to the types of administrative detention and penalty specified in the Legal Liability section of the law,the personal freedom of people involved in the violations will be restrained for a short period of time by the public security authority.In order to effectively implement the new legal requirements and maintain a good order of food safety,it is necessary to construct perfect and detailed procedural norms.
