“Through Land Governance”:Rural Land Use and Governance in Developed Regions

本文紧扣浙江省农村"通过土地治理"这一具有典型社会学意义的现象,详细呈现了浙江省农村宅基地治理的历史沿革、治理过程与治理结果。"通过土地治理"的具体意涵是基层政府试图通过拆除土地违建,倒逼家庭工业转型,进一步从根本上解决社会综合治理问题。在乡镇政府结构弱化的情况下,"通过土地治理"采取了综合执法、下乡执法的办法,这个过程导致国家与农民关系发生新变化。在土地治理过程中,由于历史因素造成普遍违法,土地执法也只能"通过模糊治理模糊"的方式进行。这背离了乡村治理法治化的初衷,在现实层面也增加了治理成本。

This paper looks closely at the typical sociological phenomenon of“land governance”in the rural areas of Zhejiang Province,and presents in detail the historical evolution,operative process and results of the governance of rural homesteads in the province.The author argues that,through land governance,the grassroots government tries to force the transformation of the family industry by demolishing illegal constructions,and,through this,to achieve comprehensive social governance.With the weakening of the township government,land governance in the form of law enforcement is sometimes taken to the village level.This process has led to new changes in the relationship between the state and farmers.In the process of land governance,due to widespread violations of the law caused by historical factors,law enforcement can only be carried out“through fuzzy governance”.This deviates from the original intention of the rule of law in rural governance,and also increases governance costs on the practical level.
