论学校保护--以未成年人保护法学校保护章为重点

学校履行教育职能并不能等同于对未成年学生的保护,恰恰相反蕴含着侵害学生权益的风险。学校教育与学校保护之间存在张力、冲突,应予以区分而不能混同。学校对未成年学生的保护义务可作安全保障义务和权益维护义务的区分,前者主要是指学校对未成年学生人身安全的保障义务,后者是指学校在实施教育管理活动中对未成年学生主体地位和平等地位的尊重及合法权益的维护,两种类型保护义务有着重大差别不宜混同,未成年人保护法学校保护章宜进一步厘清立法思路。

Schools performing its educational function does not mean school protecting minor students,on the contrary,it contains the risk of infringing on students'rights and interests.There are tension and conflict between school education and school protection,which should be distinguished rather than confused.The content of school protection obligation should embrace two parts,one obligation is to guarantee students'safety and security,and the other is to safeguard students'rights and interests.The former refers to the responsibility of school safeguarding the personal safety of minor students,the latter refers to the respect for the main position and equal status of students and the protection of legitimate rights and interests in the implementation of educational management activities.There is significant deference between these two types of protection obligations,which should not be confused.The legislation thoughts on the revision of the school protection chapter of the Law on the Protection of Minors should be further clarified.
