摘要 我国教育法治进程不断推进,无论是高校自身还是国家机关都建立了相应的机构和制度来解决高等教育领域的纠纷。这些机制中最为典型的主要包括教育申诉制度、教育调解制度、教育仲裁制度和教育诉讼制度等。这些制度在实际运行中主要存在重点不突出、内部救济渠道不畅通、部分救济制度之间出现功能重合以及诉讼救济标准不明确等问题。针对这些问题,应当提升学生权利观念、完善申诉制度的主导地位、建立不同救济形式之间的衔接与协调、完善相关法律规范等措施来实现高校内部纠纷多元化解决机制的有效运行。 In recent years,the process of the rule of law in education has progressed continuously.Both universities and government agencies have established corresponding institutions and systems to resolve disputes in the field of higher education,among which the most typical types mainly include education appeal system,education mediation system,education arbitration system and education litigation system.In the actual operation of these systems,there are typical problems such as focus lack,blocked internal remedy channels,overlaps of functions between remedies systems,and unclear litigation standards.In response to these problems,measures should be taken to clarify the concept of student rights,specify the dominant position of the appeal system,establish the connection and coordination between different forms of remedies,and improve relevant laws and regulations to realize the effective operation of the diversified resolution mechanism of internal disputes in universities.
