摘要
目前,固体废物常混杂在正常货物中试图进口,这给整批货物的固体废物属性鉴别带来了困难。为解决这一难题,梳理了相关法律法规,并结合实际案例,总结出固体废物和非固体废物混合物的属性判定方法:从"工艺来源或产生来源的合理性"和"明显混入有害组分"这两个要点分析判断,当该批固体废物和非固体废物混合物的工艺产生来源不合理,且混入的固体废物属于有害组分时,该批固体废物和非固体废物混合物应整体综合判定为固体废物。该判定方法可为进口固体废物的属性鉴别及监管提供技术支持。
At present, solid waste was often mixed with normal goods to try to import, which made it difficult to identify the solid waste properties of the whole batch of goods. In order to solve this problem, the relevant laws and regulations, and combined with the actual case, summed up the determination method of the properties of solid waste and non-solid waste mixture: from the "rationality of process source or generation source" and "obvious mixing of harmful components", it is concluded that when the process generation source of this batch of solid waste and non-solid waste mixture is unreasonable and mixed with hazardous components, the mixture of solid waste and non-solid waste should be comprehensively determined as solid waste. The method can provide technical support for the identification and supervision of imported solid waste.
