浅析未成年人刑事责任年龄之降低——对“大连女孩被害案”的刑法思考

On the Decrease of the Age for Criminal Responsibility of Juveniles--The Criminal Thoughts on“The Murder Case of the Dalian Girl”

近年来,未成年人犯罪有低龄化发展的趋向,从孩子到恶魔仅有一步之遥,未成年人实施极端恶性暴力事件让人胆寒,前有“十二岁少年杀母案”,一句“我杀的是我妈,又不是别人”让人惊心,现有“大连女孩被害案”掀起热议。诸多未成年恶性刑事案件频发不断警醒我们现有刑事责任年龄制度的漏洞和缺陷,因此需要以优化刑事责任年龄制度为主、引入恶意补足年龄为辅,以此完善未成年人犯罪的法律干预机制。

In recent years,juvenile delinquency has tended to be younger.The cases of extremely vicious violence of juveniles made people tremble,such as the case of“the 12-year-old boy murder his mother”and the current“murder case of the Dalian Girl”,which has raised a lot of debate.The frequent occurrence of the juvenile vicious criminal cases showed that there are some loopholes and deficiencies of existing criminal responsibility age system.Therefore,it is necessary to optimize the criminal responsibility age system and introduce malicious supplementary age to improve the legal intervention of juveniles’crimes mechanism.
