合宪性审查视野下的合宪性解释研究

A Study on the Constitutionality Interpretation from the Perspective of Constitutional Review

十九大以后我国宪法发展进入合宪性审查的时代,在当代宪政制度中的合宪性审查制度有着重要的作用,其能够保证宪法的全面、有效实施。而合宪性解释因其所具有的克制等特性和价值追求,与我国合宪性审查所追求的保证法治统一与安定的目标所契合,因此合宪性解释与合宪性审查密不可分。作为合宪性审查组成部分的合宪性解释是一种法律解释原则,通过体系解释、限缩解释以及目的解释等方法在合宪性审查中运用,以达到合宪性控制的目的,并以商业强制保险为对象,运用合宪性解释原则论证其合宪性。

Since the 19th CPC National Congress,China has advanced and entered the era of constitutional review.As a vital part of the contemporary constitutional system,constitutional review can ensure the comprehensive and effective implementation of the constitution.Constitutionality interpretation is inseparable from constitutional review for its characteristics like restraint and its value pursuit are consistent with the goal of ensuring the unity and stability of the legal system pursued by China’s constitutional review.As a part of constitutional review,constitutionality interpretation is a principle of legal interpretation,which is used in constitutional review by means of systematic interpretation,restrictive interpretation and purpose interpretation in order to achieve the purpose of constitutional control.This paper takes compulsory commercial insurance as the research object and uses the principle of constitutionality interpretation to demonstrate its constitutionality.
