摘要
共享经济的迅速发展,使得共享经济模式下用工关系发生了很大变化,纠纷不断增多,而目前我国现行法律对于劳动关系认定的标准已不能适应当前的用工形式,导致司法实践中对于相同纠纷出现了不同的审理结果。本研究通过分析共享经济模式下用工形式的特点,结合国内外相关立法和司法实践,提出突破传统的非“劳动关系”即“劳务关系”的二元立法标准,在其两者中间构建劳动保护中间体,在保护服务提供者获得劳动权益保障的同时,兼顾平台企业的经济利益,促进共享经济健康发展。
With the rapid development of the sharing economy,the employment relation has changed greatly and the disputes are increasing.The current law′s recognition standard for employment relation in our country cannot adapt to the current employment form,which leads to different trial results for the same disputes in judicial practice.Therefore,by analyzing the characteristics of the employment form in the sharing economy mode,combining with the relevant legislation and judicial practice at home and abroad,this paper tries to break the dual legislative recognition standard for employment relations and build an intermediate of labor protection,so that the labor rights and interests of service providers can be protected,and the economic interests of platform enterprisesare also taken into account.This suggestion is conducive to the healthy development of sharing economy.
