摘要
新冠疫情防控中,物业服务企业(以下简称"物业")配合街道、社区组成了疫情防控的最前线。但是,由于自身职权与职责不清晰,法律、法规缺乏相应的授权,少数物业在防控过程中出现不当行为,甚至涉嫌违法,引起冲突。物业和业主之间是服务者与被服务者的民事法律关系,物业和政府之间是行政配合与被配合的行政法律关系,为了在以后公共卫生防控中,更有效地发挥物业的作用,需要把物业纳入整个的疫情防控体系中,通过法律、法规赋予其权利,规范其行为。
After the outbreak of COVID-19, property service enterprises(hereinafter referred to as property) cooperated with streets and communities to form the forefront of epidemic prevention and control. However, due to the unclear functions and responsibilities, and the lack of corresponding authorization in laws and regulations, some properties behave improperly in the process of prevention and control, leading to criticism, some are suspected of violating laws and infringing the rights of owners. The relationship between the property and the owner is the relationship between the server and the served, and the relationship between the property and the government is the relationship of cooperation and being cooperated. In order to effectively play the role of property in the future public health prevention and control work, it is necessary to integrate property enterprises into the whole epidemic prevention and control system, give them corresponding status, and regulate their corresponding behaviors.
