我国行政合同中优益权规制研究

Research on the Regulation of the Right of Priority in Administrative Contract in China

行政合同是行政主体与行政相对人缔结的协议,既有合同层面的属性,也有很强的行政色彩,本质上是一种行政管理方式。因此,作为行政合同的发起者,行政主体享有超越于一般合同当事人的特权,即行政优益权。文章基于此,首先对行政优益权进行了简单的介绍,阐释了行政优益权的主要内容,将行政优益权视作行政权力的一种,并论述了行政优益权的必要性,继而以《行政诉讼法》、最高院司法解释以及其他法律部门为依据,介绍了我国行政合同中优益权的法律规制现状,从法律规定不系统、程序控制不完善、司法救济不健全三个角度剖析了行政合同中优益权的问题,最后就如何规制行政合同中的优益权提出了对策,如完善法律法规建设、健全权力行使程序、丰富纠纷解决方式等。

The administrative contract is the agreement concluded between the administrative subject and the administrative relative person.There are both the properties of contract level and a strong administrative color.It is essentially a way of administrative management.Therefore,as the initiator of the administrative contract,the administrative subject enjoys a privilege,which transcends the rights and interests of the parties to the contract,that is,the administrative privilege.On this basis,this article first briefly introduces"administrative preferential rights"and explains the main contents of"administrative preferential rights".In addition,the author regards"administrative preferential rights"as a type of administrative power,and discusses the necessity of administrative preferential rights;then based on the"administrative procedure law",the Supreme Court's judicial interpretation and other legal departments,this article Introduced the current status of the legal regulation of preferential rights in China's administrative contracts.Then,from three angles of unsystematic legal provisions,imperfect procedure control,and imperfect judicial remedies,this paper analyzes the issue of preferential rights in administrative contracts.Finally,as for how to regulate the right of preferential rights in administrative contracts,some countermeasures have been proposed,such as improving the construction of laws and regulations,improving the procedures for exercising power,and enriching the methods of dispute resolution.
