《欧盟外观设计发展情况(2010-2019)》报告述评

Commentary on the Report EUIPO Design Focus 2010 to 2019 Evolution

2020年3月6日,欧盟知识产权局发布《欧盟外观设计发展情况(2010—2019)》报告(以下简称《报告》)。《报告》就2010年至2019年间注册共同体外观设计(the Registered Community Design,以下简称RCD)的申请、审查、注册、无效及续展等情况进行了分析和汇总说明。《报告》显示,中国RCD申请增长迅速但缺少全球领导企业,外观设计延期公告制度愈发受到申请人的青睐,EUIPO授权的外观设计的质量普遍较高。本文就《报告》所反映出的EUIPO外观设计申请的优势以及中国外观设计申请存在的不足,提出以下建议:一是继续深化我国与欧盟在知识产权领域的合作;二是鼓励外观设计域外申请,提升中国企业全球竞争力;三是探索建立外观设计延期公告制度;四是持续注重提升外观设计专利质量。

On March 6, 2020, the European Union Intellectual Property Office released the report EUIPO Design Focus 2010 to 2019 Evolution. The report analyzes and summarizes the application, review, registration, invalidation, and renewal of the Registered Community Design(RCD) from 2010 to 2019. The report shows that China’s RCD applications are growing rapidly but lack of global leading companies, the design extension announcement system is increasingly favored by applicants, and the quality of designs approved by EUIPO is generally high. This article put forwards the following suggestions based on the advantages of EUIPO design applications and the shortcomings of Chinese design applications reflected in the report: firstly, continue to deepen the cooperation between China and the EU in the field of intellectual property;secondly, encourage international design applications to enhance the global competitiveness of Chinese companies;thirdly, explore the establishment of a design delay disclosure system;fourthly, continue to focus on improving the quality of design patents.
